THE CARES ACT OF THE FEDERAL GOVERNMENT AND THE TEXAS SUPREME COURT HAVE TEMPORARY RULES FOR EVICTIONS. THERE IS A NEW AFFIDAVIT THAT NEEDS TO BE FILED WITH ALL EVICTIONS. YOUR CASE WILL BE DISMISSED IF YOU DO NOT HAVE THE AFFIDAVIT. PLEASE CLICK ON EITHER THE WORD DOCUMENT OR PDF BELOW TO DOWNLOAD THE PETITION AND THE AFFIDAVIT. Information from The Office of Court Administration:
The CARES Act (coronavirus stimulus bill) contained provisions halting many evictions for tenants in properties covered by a federally-backed mortgage for 120 days from its enactment (from March 27 until July 24). The bill provides a temporary moratorium on evictions for nonpayment of rent or any other amounts due for most residents of federally subsidized apartments, including those supported by HUD, USDA or Treasury (Low Income Housing Tax Credit developments). The bill also institutes a moratorium on filings for evictions for renters in homes covered by federally-backed mortgages for the same period. Remember also that these properties are subject to a 30-day notice to vacate requirement under the CARES Act.

This office accepts the following forms of payment: Cash, Cashier’s Check, Money Orders, Debit Cards and Major Credit Cards. On Criminal cases a payment plan will only be available after a hearing and final judgment is rendered on the case.
To request a hearing please come to the office as paperwork will need to be signed by the Defendant. If you do not live in the area of El Paso County you can contact the court via email for your options.
